Kaieteur News Reports : The High Court, led by Chief Justice (ag) Navindra Singh, has quashed a decision by Magistrate Delon Bess that dismissed three fraud charges against convicted fraudster Dave Rajeshwar Persaud.

Persaud, currently serving a three-year sentence for a separate fraud case, had charges related to financial crimes and money laundering. SOCU argued that Magistrate Bess improperly dismissed the charges on May 29, 2025, despite having set a new date due to his absence.
SOCU prosecutors were informed by the court clerk that the matters were adjourned to June 27, 2025. However, Magistrate Bess conducted hearings from a different court, leading to the dismissal of the charges in Persaud’s absence.
In his ruling, Justice Singh found the magistrate’s actions “wholly improper,” emphasizing the need for proper verification before dismissing cases. SOCU plans to reinstate proceedings against Persaud following the High Court’s decision.
Deputy Commissioner Fazil Karimbaksh expressed disappointment that legal action was necessary to uphold judicial accountability.
