In a Notice of Motion submitted to the appellate court, the duo is requesting an immediate halt to the committal hearings currently underway before Magistrate Judy Latchman. This action comes as they await the determination of their substantive appeal.

The appeal challenges the legality of the Authority to Proceed issued by the Minister of Home Affairs. The Mohameds argue that the decision is tainted by bias and is therefore unlawful. According to their claims, both the Minister and the Attorney General are politically conflicted, rendering the entire extradition process fundamentally flawed.

The applicants are also urging the Court of Appeal to expedite the hearing, emphasizing that if the committal proceedings continue, they risk being committed to custody before their appeal can be heard, which could render the appeal meaningless.

Earlier this month, their constitutional challenge was dismissed by the High Court, which also ordered costs against them. The matter has now shifted to the Court of Appeal, where the legal battle over the extradition process is poised to intensify.
